DMCA Policy – IAcorner
1. Introduction
IAcorner is committed to respecting the intellectual property rights of others and expects our users, partners, and contributors to do the same. In line with the Digital Millennium Copyright Act (DMCA), we have established this policy to address copyright infringement claims. We may remove or disable access to allegedly infringing content and may terminate access for repeat violators. Use of our services is always subject to our Terms of Service, which incorporate this DMCA Policy.
2. How to Submit a DMCA Notice
If you believe your copyrighted work has been copied, posted, or shared in a way that violates your rights, you must provide a written Notification of Claimed Infringement to our Designated Agent. The notice must include all of the following details, as required by 17 U.S.C. §512(c)(3):
-
A physical or electronic signature of the copyright owner or an agent authorized to act on their behalf.
-
Identification of the copyrighted work(s) you claim have been infringed.
-
Identification of the material you believe to be infringing, including its specific location (such as a URL) so that we can locate it.
-
A statement declaring you have a good-faith belief the use of the material is not authorized by the copyright owner, the agent, or the law.
-
Your contact information, including your full legal name, address, phone number, and email address.
-
A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
Incomplete or invalid notices may not be processed.
3. What We Do After Receiving a Proper Notice
Upon receipt of a valid DMCA Notice, IAcorner may:
-
Remove or block access to the infringing material.
-
Notify the user or content provider who uploaded the content.
-
Apply our repeat-infringer policy, which could include limiting, suspending, or terminating accounts.
4. Submitting a Counter-Notice
If you believe that material you uploaded was removed in error or due to misidentification, you may file a Counter-Notice with our Designated Agent. Your counter-notice must include:
-
Your physical or electronic signature.
-
Identification of the material that was removed or disabled and its prior location before removal.
-
A statement, made in good faith and under penalty of perjury, that the removal or disabling was due to mistake or misidentification.
-
Your name, mailing address, phone number, and email.
-
A statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the U.S., any district where IAcorner may be found) and that you will accept service of process from the complainant or their agent.
Once a valid counter-notice is received, IAcorner may forward it to the original complainant. Unless the complainant files legal action within 10–14 business days, we may reinstate the removed content at our discretion.
5. Repeat-Infringer Policy
Users who receive multiple valid copyright complaints may be considered repeat infringers. At our discretion, we may restrict, suspend, or permanently terminate such accounts.
6. Misrepresentation Warning
Submitting false or misleading DMCA notices or counter-notices can result in legal liability under 17 U.S.C. §512(f). If you are uncertain about your rights, you should consult with an attorney before filing.
